Women (WE) category She had applied for a government job<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What happened during selection?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There was only one seat reserved for the BC-WE category That seat was already filled by another BC-WE candidate<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ms. Deepti Kalal was therefore placed in the reserve\/waiting list She was the only candidate from BC-WE category in that reserve list<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Issues in this case &#8211; Cut-off Marks<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here&#8217;s where the problem started:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BC-WE category cut-off: 61 marks<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">General category cut-off: 58 marks<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means the General category cut-off was LOWER than the reserved category cut-off.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And importantly:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The BC-WE candidate who got selected had more than 58 marks She had not taken any reservation benefit, except fee relaxation<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What was Ms. Deepti Kalal&#8217;s argument?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She said:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Since the selected BC-WE candidate scored more marks than the General category cut-off, she should NOT have been given the reserved seat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She should have been shifted (migrated) to the General Women category.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If that happened:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The BC-WE seat would become vacant<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And since Ms. Deepti Kalal was next in merit and only candidate in the reserve list,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She should get that BC-WE seat<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What did the High Court say?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Farjand Ali agreed with her.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court explained a very important principle:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">General category is an open merit category<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anyone &#8211; SC, ST, OBC, or General can be selected in it if they score enough marks<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Supreme Court cases relied upon<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court relied on settled Supreme Court law, especially:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1 Deepa E.V. v Union of India Supreme Court held that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a reserved category candidate scores more than general cut-off and takes no relaxation except fee Then she must be selected in General category<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2 Bharat Sanchar Nigam Limited v Sandeep Choudhary<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Supreme Court clearly said: Merit migration is mandatory<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once conditions are satisfied, authorities have no discretion<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Final Decision of the Court<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court held that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The selected BC-WE candidate should have been placed in the General<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Women category Because of that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A BC-WE seat became vacant<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ms. Deepti Kalal, being next in merit, was entitled to that seat The Court said the failure to migrate the candidate was:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Illegal<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfair<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And vitiated the entire selection process<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>This case came before the Rajasthan High Court, where the Court had to decide how reserved category candidates should be treated when they score more marks than general category candidates.
